1. Acceptance of Terms

By accessing or using the services provided by Finestra (“we,” “us,” or “our”), including FinestraSaaS, FinestraSales, FinestraMeasure, and related applications (collectively, the “Services”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, you may not use the Services. These Terms apply to all users, including customers, sales representatives, installation technicians, and administrators.

2. Description of Services

Finestra provides cloud-based software solutions for window and door manufacturing businesses, including manufacturing management, order processing, customer relationship management, field measurements, quoting, invoicing, production tracking, quality control, scheduling, payroll, and communication tools including SMS text messaging and email. Our Services are designed to streamline operations for window and door companies and their customers.

3. User Accounts

To access certain features of the Services, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary. You must notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms.

4. SMS Text Messaging Terms

By providing your phone number and opting in, you consent to receive SMS text messages from Finestra for the following purposes:

  • Order confirmations and status updates
  • Appointment and installation reminders
  • Quote notifications and follow-ups
  • Production milestone updates
  • Customer service communications
  • Promotional offers and marketing messages (with separate consent)

Opt-In: You opt in to receive messages by providing your phone number during account creation, quote requests, or appointment scheduling, or by texting a designated keyword to our phone number.

Opt-Out: You may opt out of SMS messages at any time by replying STOP to any message from us. After opting out, you will receive a confirmation message and no further messages unless you opt back in.

Message Frequency: Message frequency varies based on your orders and account activity. Standard message and data rates may apply depending on your mobile carrier plan.

No Sharing: We will not sell, rent, or share your phone number or opt-in consent with any third parties for marketing purposes.

Carriers: Carriers are not liable for delayed or undelivered messages. SMS services are available on all major US carriers.

5. Acceptable Use

You agree not to:

  • Use the Services for any unlawful purpose or in violation of any applicable laws
  • Attempt to gain unauthorized access to the Services, other accounts, or our systems
  • Interfere with or disrupt the integrity or performance of the Services
  • Upload or transmit viruses, malware, or other harmful code
  • Use the Services to send unsolicited messages or spam
  • Reverse engineer, decompile, or disassemble any part of the Services
  • Resell, sublicense, or redistribute the Services without our written consent

6. Intellectual Property

All content, features, functionality, designs, trademarks, and intellectual property associated with the Services are owned by Finestra or its licensors and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Services in accordance with these Terms. You may not copy, modify, distribute, or create derivative works based on our Services without prior written consent.

7. Your Data

You retain ownership of all data you submit through the Services (“Your Data”). You grant us a limited license to use, process, and store Your Data solely to provide the Services to you. We will handle Your Data in accordance with our Privacy Policy. You are responsible for the accuracy and legality of Your Data.

8. Payment Terms

Certain features of the Services may require payment of subscription fees. All fees are stated in US dollars and are non-refundable unless otherwise specified. We reserve the right to change pricing with reasonable advance notice. Failure to pay may result in suspension or termination of your access to paid features.

9. Disclaimers

The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure. We are not responsible for any manufacturing defects, installation issues, or product performance related to windows and doors ordered through the Services.

10. Limitation of Liability

To the maximum extent permitted by law, Finestra shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or related to your use of the Services. Our total liability for any claims arising under these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Finestra, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your use of the Services, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

We may suspend or terminate your access to the Services at any time, with or without cause, and with or without notice. Upon termination, your right to use the Services will immediately cease. You may request a copy of Your Data within 30 days of termination. Provisions that by their nature should survive termination will remain in effect.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Orange County, California.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page with a new effective date. Your continued use of the Services after changes are posted constitutes your acceptance of the modified Terms.
